Lavish Morocco Terms & Conditions of Membership

These Terms & Conditions of Membership (“Conditions”) apply to all services offered and provided by Lavish Morocco. By requesting services from Lavish Morocco, you agree that these conditions shall govern the services provided to you as a member.

1. Definitions and Interpretation

1.1 In these Conditions, the following definitions apply:

  • Benefits: Services and advantages offered to Members by Suppliers.
  • Conditions: These terms and conditions applicable to Lavish Morocco Membership.
  • Membership: Enrollment in the Lavish Morocco Membership Club.
  • Member: An individual registered as a member of the Lavish Morocco Membership Club.
  • Membership Fees: Fees payable for Membership.
  • Request: Member’s request for goods and/or services from third-party Suppliers facilitated by Lavish Morocco.
  • Services: Concierge, lifestyle management, and exclusive services provided to Members.
  • Supplier: A third-party entity engaged by Lavish Morocco to provide goods and/or services to Members.

1.2 In these Conditions:

  • Terms like “Member,” “Service,” and “Supplier” refer to their definitions mentioned above.
  • References to laws, provisions, and statutes include amendments or re-enactments.
  • Phrases such as “including,” “include,” or “in particular” are illustrative, not limiting the preceding words’ sense.
  • “Writing” or “written” encompasses emails and electronic communication.

2. Membership Applications and Your Membership Card

2.1 Membership applications are subject to Lavish Morocco’s acceptance at its sole discretion. Upon acceptance, Members will be notified. 2.2 Members must provide accurate personal details upon application and promptly update Lavish Morocco in case of any changes. 2.3 Lavish Morocco encourages Members residing in multiple territories to register initially with the office in their primary residence’s territory. 2.4 Upon receipt of Membership and Joining Fees, Lavish Morocco will issue the Membership Card and associated documentation. 2.5 Membership is personal, and Members are responsible for restricting usage except for their personal assistants, if applicable. 2.6 Members are responsible for the confidentiality of their user credentials for website access. Any breach must be reported immediately. 2.7 Lavish Morocco adheres to strict data security standards outlined in the privacy policy, ensuring secure storage and transmission of information. 2.8 Lost or stolen Membership Cards must be reported promptly to Lavish Morocco via email at [Email Address].

3. Membership Fees, Upgrades, Cancellations, and Renewals

3.1 Membership and Joining Fees will be confirmed upon acceptance of the Membership application. Joining Fee payment is due upon acceptance. 3.2 Payment of the Joining Fee signifies the Member’s request for service initiation by Lavish Morocco. 3.3 Membership Fees are non-refundable except within the Cancellation Period. Joining Fees are non-refundable. 3.4 Members have a 14-day Cancellation Period. Notice of cancellation must be in writing. 3.5 Cancellation within the Cancellation Period incurs deductions for Services already performed. 3.6 Lavish Morocco reserves the right to cancel or suspend Membership, offering pro-rata refunds where applicable. 3.7 Membership Fees are due on acceptance and annually thereafter. Payment methods include direct debit or authorized credit/debit card deductions. 3.8 Lavish Morocco may collect renewal Membership Fees up to 28 days before the Renewal Date or contact Members directly for renewal. 3.9 Members must notify Lavish Morocco at least 30 days before the Renewal Date to opt-out of renewal. 3.10 Failure to notify may result in automatic Membership renewal, and fees may be charged accordingly. 3.11 Upgrading Membership requires payment of the price difference on a pro-rata basis. 3.12 Refunds for returns or cancellations are subject to Supplier policies and terms.

4. Supply of Services

4.1 Lavish Morocco shall provide Services according to Member Requests, complying with laws, standards, and ethical guidelines. 4.2 Reasonable efforts will be made to meet performance timelines, but these shall be considered estimates. 4.3 Lavish Morocco reserves the right to make necessary changes to Services, ensuring legal compliance and informing Members accordingly. 4.4 Services will primarily be offered in English (and other languages as appropriate). 4.5 After hours, Member queries may be redirected to an alternate Lavish Morocco office, with services provided in English. 4.6 Lavish Morocco may accept commissions upon the supply of products or services by Suppliers. 4.7 Telephone calls to Lavish Morocco may be monitored or recorded for quality control purposes. 4.8 Services will be provided with reasonable care and skill, adhering to Member instructions where possible.

5. Placing a Request

5.1 Requests can be made via telephone, email, or the Member’s section on the Lavish Morocco website. 5.2 Members should contact the primary office for all Requests, including international Requests. 5.3 Lavish Morocco reserves the right to refuse or withdraw Services at its discretion. 5.4 Accuracy of details and Payment Card information is the Member’s responsibility. 5.5 Some services may incur additional charges notified in advance, and Members authorize Lavish Morocco to debit the Payment Card for such charges.

6. Cancellations, Refunds, and Returns

6.1 Contract cancellations with Suppliers are governed by their policies. 6.2 Unavailable products or services may be substituted, subject to Member discretion. 6.3 Descriptions on the Website are approved by Suppliers; Lavish Morocco is not liable for inaccuracies. 6.4 Payment for products or services is due immediately upon Supplier acceptance. 6.5 Returns or exchanges are subject to Supplier terms, and Lavish Morocco will communicate these to Members. 6.6 Members are responsible for retaining proof of return of goods to Suppliers.

7. Suppliers

7.1 Suppliers are responsible for supplying products and services to Members. 7.2 Supplier terms and conditions apply to goods/services supplied by them. 7.3 Members authorize Lavish Morocco to use their Payment Card for Supplier payments as instructed. 7.4 Benefits are subject to availability and may change without notice.

8. Limitation of Liability

8.1 Lavish Morocco’s liability is limited, except in cases of negligence, fraud, or legal obligations. 8.2 Lavish Morocco is not liable for indirect losses or damages arising from Membership. 8.3 Members’ contracts with Suppliers are independent; Lavish Morocco is not liable for Supplier actions. 8.4 Lavish Morocco isn’t responsible for Member errors, delays, or omissions. 8.5 Delays or failures in service due to reasons beyond Lavish Morocco’s control are not liable. 8.6 All warranties, except as stated in these Conditions, are excluded.

9. Commencement and Termination

9.1 These Conditions bind Members and Lavish Morocco upon Membership acceptance. 9.2 Termination occurs upon Membership expiry or termination. 9.3 Members’ rights and remedies apply to Lavish Morocco (UK) Limited only.

10. General

10.1 Privacy and Data Protection: Membership is subject to Lavish Morocco’s privacy policy, ensuring data protection. 10.2 Assignment and subcontracting: Lavish Morocco may assign rights or subcontract obligations. 10.3 Waiver: Written waivers are effective; non-exercise of rights doesn’t waive them. 10.4 Severance: Invalid clauses are deleted, and the rest remain enforceable. 10.5 Variation: Lavish Morocco may vary Conditions, notifying Members of changes. 10.6 No partnership: These Conditions don’t establish a partnership or joint venture. 10.7 Third parties: Persons not party to these Conditions have no rights. 10.8 Governing law and jurisdiction: English law governs these Conditions; the courts of England and Wales have exclusive jurisdiction.
